In 2004, UCLA Law Professor Richard Sander published a controversial article in the Stanford Law Review arguing that an end to affirmative action would benefit minority students. His article claimed to empirically demonstrate that affirmative action in law schools hurts Black students because it results in Black students attending schools where they are in no position to compete academically (the “mismatch theory”). Sander and his research team now seek confidential applicant data from the State Bar of California to gain further support for the mismatch theory.

Sander and his team seek Bar applicant data “consist[ing] of LSAT scores, race, gender, law school attended, repeater status, and bar exam scores of all those taking the bar exam for the first time between from 1997 to 2003” as well as background data on black and Latino law students from 2004 and 2005.
